1.1. These terms and conditions set out the rules for using the citytourgdansk.pl website, operated by CITY TOUR Gdańsk Leszek Nowak.
1.2. The website enables the purchase of tickets for journeys by melexes and buses offered by CITY TOUR Gdańsk.
1.3. Use of the service constitutes acceptance of these terms and conditions.
2.1. Administrator – CITY TOUR Gdańsk Leszek Nowak, conducting business activity with its registered office at 6/86 Granitowa Street, 80-030 Gdańsk, NIP: 5832488285.
2.2. Service – the website available at www.citytourgdansk.pl.
2.3. User – a natural or legal person using the service to purchase transport services.
2.4. Service – journeys by melexes and buses offered by the Administrator as part of the service.
3.1. The service enables Users to purchase tickets for journeys offered by CITY TOUR Gdańsk.
3.2. A ticket is purchased by selecting the appropriate ticket, providing contact details and making payment via the service.
3.3. After making a purchase, the User receives purchase confirmation at the email address provided when placing the order.
3.4. The Administrator will contact the User to arrange the date and time for the service to be provided.
3.5. The service is provided in accordance with the arrangements made with the User.
4.1. Payments for purchased tickets are made using the payment methods available on the service.
4.2. The price stated for the ticket is the gross price and includes all applicable charges.
4.3. The Administrator reserves the right to introduce promotions and discounts on the services offered.
5.1. Right of withdrawal from the contract:
A User who is a consumer has the right to withdraw from a distance contract within 14 days from the date on which the contract was concluded, without giving any reason, except where the purchase concerns a journey on a specified date that cannot be changed (in accordance with Article 38(12) of the Consumer Rights Act).
The above right of withdrawal from the contract may also be exercised by businesses making a purchase for purposes connected with their business activity, if it follows from the content of the contract that the purchase is not of a professional nature for them (in accordance with Article 38a of the Consumer Rights Act).
5.2. To exercise the right of withdrawal from the contract, the User should inform the Administrator of their decision by sending a statement by email to: citytour.Gdansk@yahoo.com.
5.3. The Administrator shall refund the payment to the User without undue delay, no later than within 14 days from the date of receipt of the withdrawal statement, using the same method of payment as was used for the original transaction.
5.4. Complaints concerning the provision of services may be submitted by email to: citytour.Gdansk@yahoo.com.
5.5. Complaints will be considered within 14 days of their submission.
5.6. The complaints procedure also takes into account the rights of business consumers referred to in section 5.1.
6.1. The Administrator processes Users’ personal data in accordance with applicable laws and the service’s Privacy Policy.
6.2. Providing personal data is voluntary, but necessary for the order to be processed.
7.1. The User is obliged to use the service in accordance with the law and these terms and conditions.
7.2. The User may not use the service in a manner that infringes the rights of third parties, including copyright and intellectual property rights.
8.1. The Administrator shall not be liable for disruptions to the operation of the service caused by force majeure, acts of third parties or the improper operation of the User’s devices.
8.2. The Administrator shall not be liable for delays in providing the service resulting from the User’s fault, such as a lack of contact to arrange the date of the journey.
9.1. The Administrator reserves the right to make changes to these terms and conditions. Users will be informed of changes on the service’s website.
9.2. Matters not governed by these terms and conditions shall be subject to the provisions of Polish law, including the Consumer Rights Act and the Civil Code.
9.3. Any disputes arising from the use of the service shall be resolved by the competent ordinary court.
